1. Introduction and Purpose

Innovatica Technologies FZ-LLC (“Innovatica,” “we,” or “our”) is a forward-thinking technology company specializing in artificial intelligence, custom software development, and strategic consulting. Through our Brilio platform (“Brilio” or the “Platform”), we enable users to build, maintain, host, and monetize AI Agents.

This AI Ethics and Responsible Use Policy (“Policy”) establishes the binding ethical framework and mandatory responsible use guidelines that govern the development, deployment, and use of artificial intelligence technologies within our Brilio platform.

The purpose of this Policy is to:

  1. Establish clear ethical principles that guide our AI development and implementation
  2. Define responsibilities for all stakeholders in our AI ecosystem
  3. Provide transparency about our approach to ethical AI
  4. Mitigate risks associated with AI technologies
  5. Ensure compliance with applicable laws and regulations

This Policy should be read in conjunction with our other governing documents, including our Terms of Service, Privacy Policy, Data Retention and Deletion Policy, and Agent Content Guidelines.

2. Scope of Application

This Policy applies to:

  1. Innovatica Technologies FZ-LLC and its employees involved in the development, implementation, and management of the Brilio platform
  2. All users of the Brilio platform, including agent creators and users who interact with agents
  3. Third-party service providers and partners that integrate with the Brilio platform
  4. All AI Agents created, hosted, or deployed on the Brilio platform

3. Ethical Principles

Our AI ethics framework is built on the following core principles:

3.1 Human-Centered Approach. We design and develop AI systems with human welfare and wellbeing as our primary consideration. Our technology aims to help organizations turn complex challenges into opportunities by delivering intelligent, scalable, and secure solutions that drive real business value.

3.2 Respect for Human Autonomy. We respect human decision-making autonomy and design AI systems to augment human capabilities rather than replace human judgment in critical decision-making processes. Our platform clearly states that AI can make mistakes and that it is expected that users check results and apply due diligence before using the results.

3.3 Prevention of Harm. We are committed to developing AI systems that neither cause nor exacerbate harm or adversely affect human rights. While AI Agents can be used for private purposes or within companies for creating internal or external agents, we design our platform with technical safeguards and enforcement mechanisms to prevent, detect, and mitigate potential misuse, as further detailed in our Security Policy and Acceptable Use Policy.

3.4 Fairness. We strive to ensure that our AI systems treat all people fairly and do not discriminate against any individual or group. We acknowledge that representation in data and algorithm design impacts outcomes.

3.5 Transparency. We provide clarity about when AI is being used, what data sources are employed, and the limitations of our AI systems. We do not misrepresent our AI capabilities.

3.6 Privacy and Data Governance. We respect user privacy and implement robust data governance practices. We store data securely, following best industry practices, and provide users with control over their data, including the ability to request data deletion when they close their account.

3.7 Security and Robustness. Our Brilio platform is built on high security standards and is independently reviewed by security experts in the field to ensure that breaches cannot happen within platform components. All breaches that may occur on the cloud provider side are thoroughly investigated.

4. Transparency Commitments

4.1 AI Identification. We clearly disclose when AI is being used in our platform. The platform provides a clear statement that AI can make mistakes and that it is expected that users check results and apply due diligence before using the results.

4.2 Information About AI Systems. We provide accessible information about:

  1. The capabilities and limitations of our AI Agents
  2. The data sources used to train agents
  3. How data is processed, transformed, and stored
  4. The circumstances under which user data may be accessed by third-party providers
  5. The methodology for evaluating and mitigating potential biases in our AI systems, including information about the representativeness of training data and the steps taken to address identified biases.

4.3 Explainability. Where technically feasible, we provide explanations about AI decisions in a manner appropriate to the context and user needs. We acknowledge that different levels of explainability may be required depending on the use case and potential impact.

4.4 Disclosure of Third-Party Services. We disclose the third-party services integrated with our platform, which may include payment gateways, analytics platforms, cloud services, LLM providers like OpenAI and Anthropic, and other external tools for performance monitoring, email delivery, and customer support.

5. Fairness and Bias Mitigation

5.1 Bias Recognition and Mitigation. We recognize that AI systems may reflect or amplify existing societal, historical, and statistical biases present in training data. We have implemented and continually improve the following specific procedures to:

  1. Identify potential sources of bias in our AI systems
  2. Mitigate identified biases through algorithmic adjustments and diversity in training data
  3. Regularly test our systems for unfair bias
  4. Clearly communicate that AI can make mistakes and that users should apply due diligence before using results

5.3 Fair Treatment. We commit to designing AI systems that treat all individuals fairly, without privileging or disadvantaging any individual or group. Agent creators are responsible for setting up appropriate age restrictions for each agent.

5.4 Feedback and Improvement. We provide mechanisms for users to report any misuse of the platform, such as inappropriate agent names, and commit to acting on these reports within 72 hours.

5.5 Bias Reporting Mechanism. We provide a dedicated channel for users to report potential biases observed in our AI systems. Reports are reviewed by a specialized team that evaluates the reported issues and implements appropriate remediation measures. We commit to acknowledging such reports within 72 hours and providing updates on actions taken within 30 days.

6. Human Oversight and Intervention

6.1 Human-in-the-Loop Systems. Our platform is designed for interactive and dynamic conversations, enabling users to ask questions and receive personalized responses on various topics, create events/actions based on metrics, etc. We maintain appropriate human oversight throughout the AI lifecycle, including development, deployment, and use.

6.2 Oversight Mechanisms. We implement the following oversight mechanisms:

  1. Regular security audits and vulnerability assessments conducted at least quarterly by qualified internal staff and annually by independent third-party security experts, as detailed in our Security Policy.
  2. Review processes for agents prior to their release, including both automated checks for compliance with platform guidelines and manual review by the platform’s moderation team
  3. Reporting features for users to flag problematic agents
  4. Automated and manual content moderation techniques

6.3 Intervention Procedures. We employ automated and manual content moderation techniques to proactively identify and prevent harmful or inappropriate content from being published on the platform. Content violation reports submitted by users are typically reviewed within 24 to 48 hours.

6.4 Accountability for Human Decisions. We maintain clear accountability for decisions made by humans in the oversight process. Agents must not be used for any illegal, harmful, or unethical purposes. Our moderation team evaluates reported content and takes appropriate action, which may include removal, warning, or suspension depending on the severity of the violation.

7. Use Limitations for High-Risk Applications

7.1 Prohibited Uses. The Brilio platform and its AI Agents must not be used for any illegal, harmful, or unethical purposes. Prohibited use cases include, but are not limited to, generating or disseminating misinformation, promoting violence, or engaging in discrimination or harassment.

7.2 High-Risk Applications. We recognize that certain applications of AI technology carry heightened risks. For high-risk applications, including but not limited to those affecting health, safety, critical infrastructure, essential public services, law enforcement, migration, or fundamental rights, we strictly require:

  1. Enhanced human oversight
  2. Additional validation and testing
  3. Clear disclosure of limitations
  4. Specialized training for users

7.3 Age-Appropriate Design. Agent creators are responsible for setting up appropriate age restrictions per each agent. Brilio platform has no age restrictions (4+).

7.4 Enforcement. Any agent found violating these terms may be suspended or removed from the platform. User accounts may be suspended, subject to any detected misuse of Brilio resources, infrastructure, software, etc. without previous warning.

7.5 Prohibited High-Risk Uses. The following high-risk applications are expressly prohibited on the Brilio platform:

  1. Automated decision-making systems that could lead to denial of essential services or benefits without meaningful human review
  2. AI applications that could enable real-time biometric identification systems in publicly accessible spaces for law enforcement purposes
  3. AI systems designed to manipulate human behavior to circumvent users’ autonomy
  4. AI-based social scoring systems for general purposes by public authorities
  5. Applications that could enable or facilitate the development of autonomous weapons systems

8. Accountability Framework

8.1 Responsibility Matrix. While content created by agents is primarily the responsibility of the agent creator, Innovatica maintains oversight responsibility for the platform’s operation. Agent creators are liable for intentional misuse and negligent provision of harmful information, subject to Section 8.5’s liability limitations. Innovatica retains responsibility for implementing reasonable technical safeguards and moderation systems as detailed in our Security Policy and Terms of Service.

Specifically:

  1. Agent creators are responsible for ensuring they have necessary permissions to use agent data.
  2. Brilio platform is not responsible for misuse or wrong information provided by an agent.
  3. Agent creators are responsible for setting up appropriate age restrictions.
  4. Agent creators agree to cover any costs or claims that arise from their use of third-party data or materials within the platform without necessary licenses.

8.2 Intellectual Property and Content Rights. The platform holds ownership of all AI-generated content and provides users with a license to use it within their agents. Licensing of the AI-generated content is non-exclusive, meaning it allows users to use AI-generated content as they see fit while keeping rights for the platform to use content to improve answers of other platform agents, using de-identified content from other accounts.

8.3 Documentation and Record Keeping. We maintain appropriate documentation regarding:

  1. Data sources used for training agents
  2. Security audits and vulnerability assessments
  3. Actions taken in response to user reports
  4. Content moderation decisions and appeals

8.4 Dispute Resolution. In the event of any disputes arising from the use of our platform, both parties agree to resolve the matter through binding arbitration, rather than through court proceedings. Arbitration will be conducted under the rules of a recognized arbitration body, such as the International Chamber of Commerce (ICC), and will take place in a mutually agreed location. The decision made by the arbitrator(s) will be final and legally binding.

8.5 Liability Limitations. Our liability for any claims arising from the use of the platform is limited to the amount paid by the user for the service in the 6 months preceding the claim. This limitation applies regardless of the cause of the claim, whether it is contractual, tortious, or based on other legal theories. However, nothing in this Policy shall exclude or limit our liability for:

  1. death or personal injury resulting from our negligence;
  2. fraud or fraudulent misrepresentation; or
  3. any other liability that cannot be excluded or limited under applicable law.

9. Continuous Improvement Commitments

9.1 Monitoring and Evaluation. We implement systems to monitor agent performance and user feedback. Users have the ability to rate and review agents based on their experience. Ratings help improve agent quality by providing feedback to creators.

9.2 Research and Development. We invest in ongoing research and development to improve the ethical performance of our AI systems, including:

  1. Easy incorporation of newly available components, such as LLMs, data parsing, processing, and transforming tools to allow the platform to evolve and stay up to date.
  2. Addressing identified ethical issues in existing systems
  3. Exploring new approaches to enhancing fairness, transparency, and accountability

9.3 Knowledge Sharing. We participate in industry knowledge-sharing initiatives to contribute to the advancement of ethical AI practices while respecting our intellectual property and competitive position.

9.4 Training and Awareness. We provide training resources for:

  1. Platform users to understand AI limitations, with clear statements that AI can make mistakes and that users should check results and apply due diligence.
  2. Agent creators regarding their responsibilities for data permissions and content quality.
  3. Setting appropriate age restrictions for agents.

9.5 Environmental Impact. We are committed to minimizing the environmental impact of our AI systems. This includes:

  1. Monitoring and optimizing the energy consumption of our AI infrastructure
  2. Implementing energy-efficient algorithms where feasible
  3. Utilizing renewable energy sources where available for our cloud infrastructure
  4. Regularly reporting on our environmental impact and improvement measures through our corporate sustainability reporting

10. Stakeholder Engagement

10.1 User Feedback. We actively seek and incorporate user feedback to improve our platform. Users have the ability to rate and review agents based on their experience. Users have an ability to report any misuse of the platform, for example, for inappropriate agent names. Brilio support will act based on the report in not more than 72 hours.

10.2 Multi-Stakeholder Collaboration. We proactively engage with diverse stakeholders, including users, industry partners, civil society organizations, academia, affected communities, and regulators, through structured consultation mechanisms to incorporate varied perspectives into our AI ethics approach. We conduct formal stakeholder consultations at least annually and maintain ongoing feedback channels.

10.3 Public Communication. We communicate transparently about our AI ethics principles, practices, and challenges through appropriate channels, including our website, documentation, and direct user communications.

10.4 Appeals Process. Users who disagree with content removal decisions have the right to appeal. Appeals can be submitted through the platform’s designated support channels, where they will be reviewed by a senior moderation team. The outcome of the appeal will be communicated to the user within 5 business days.

11. Compliance and Enforcement

11.1 Regulatory Compliance. We adhere to relevant data protection regulations, including GDPR, CCPA, and others, ensuring that user data is processed in a secure and compliant manner. The platform operates with clients from all over the world, which means it has to align with all current laws, specifically EU/GDPR standards.

11.2 Internal Compliance Mechanisms. We implement processes to ensure compliance with this Policy throughout our organization, including:

  1. Regular training for employees on AI ethics
  2. Integration of ethical considerations into development workflows
  3. Periodic security audits and vulnerability assessments to identify and mitigate potential threats

11.3 Enforcement Procedures. Any agent found violating our terms will be subject to a graduated enforcement approach:

  1. For minor violations, the agent creator will receive a warning and be given 72 hours to remediate the issue;
  2. For moderate violations or failure to remediate after warning, the agent will be temporarily suspended until compliance is achieved;
  3. For severe violations or repeated non-compliance, the agent will be permanently removed from the platform and the user account may be suspended.

In cases where misuse affects platform security, stability, or other users’ experience, immediate action may be taken without prior warning, as determined by the Brilio platform governance team in accordance with our Acceptable Use Policy.

11.4 Reporting Mechanisms. Users have an ability to report any misuse of the platform, for example, for inappropriate agent’s names. Brilio support will act based on the report in not more than 72 hours. Users can report problematic agents via a dedicated reporting feature within the platform. Reports will be reviewed by our support and moderation teams, and actions such as warnings, suspension, or removal of the agent may be taken based on the severity of the issue.

12. Policy Updates and Revisions

12.1 Review Frequency. This Policy will be reviewed at least annually and updated as necessary to reflect changes in technology, legal requirements, and ethical best practices.

12.2 Change Management. For any significant changes to the platform, including major updates, feature removals, or system upgrades, we will provide users with a minimum 30 days’ notice. This notice will be communicated via email, in-app notifications, or other appropriate channels.

In cases of emergency or unforeseen circumstances, we may provide a shorter notice period but will make every effort to minimize disruption and ensure users are adequately informed.
